In short: These terms govern your use of our applications. Please read them carefully. By using our Apps, you agree to these terms.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and INNOVASFT PTE. LTD. ("INNOVASFT," "we," "us"), a company registered in Singapore. By downloading, installing, accessing, or using any of our applications ("Apps"), you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must discontinue use of our Apps immediately.
2. Our Services
INNOVASFT develops and publishes mobile applications designed to help people solve problems, save time, and improve their quality of life. Our Apps are distributed primarily through the Apple App Store and may also be available on other platforms.
We reserve the right to modify, suspend, or discontinue any App or feature at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.
3. User Accounts
Some of our Apps may require you to create an account. When doing so:
- You must provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately at [email protected] if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use our Apps for any unlawful purpose or in violation of any applicable laws.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of our Apps.
- Distribute, modify, or create derivative works based on our Apps without authorization.
- Interfere with or disrupt the integrity or performance of our services.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use our Apps to transmit harmful, offensive, or infringing content.
- Use automated means (bots, scrapers) to access our services without permission.
5. Intellectual Property
All content, features, functionality, design, code, trademarks, and other intellectual property within our Apps are owned by or licensed to INNOVASFT and are protected by international copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of any content you create within our Apps. By using our Apps, you grant us a limited, non-exclusive license to process and store your content solely for the purpose of providing the service to you.
6. Purchases & Subscriptions
Some of our Apps offer in-app purchases or subscriptions. These transactions are processed entirely by Apple through the App Store.
- Pricing: All prices are displayed in your local currency within the App Store. Prices may vary by region and are subject to change.
- Subscriptions: Auto-renewing subscriptions will be charged to your Apple ID account. You may manage or cancel subscriptions through your device's Settings → Apple ID → Subscriptions.
- Free Trials: If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends.
- Refunds: All purchases are subject to Apple's refund policy. To request a refund, please contact Apple Support directly through reportaproblem.apple.com.
7. Termination
You may stop using our Apps at any time by uninstalling them and, if applicable, deleting your account (see our Account Deletion section).
We may suspend or terminate your access if you violate these Terms, with or without prior notice. Upon termination, your right to use the Apps ceases immediately.
8. Disclaimers
Our Apps are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, INNOVASFT disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our Apps will be uninterrupted, error-free, secure, or free of harmful components. Your use of our Apps is at your sole risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, INNOVASFT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our Apps.
Our total aggregate liability for any claims arising from or related to our Apps shall not exceed the amount you paid to us (through the App Store) in the twelve (12) months preceding the claim, or fifty Singapore dollars (SGD 50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, the limitations above shall apply to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless INNOVASFT, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of our Apps, your violation of these Terms, or your violation of any third-party rights.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If no resolution is reached within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Singapore.
Nothing in these Terms shall limit your rights under mandatory consumer protection laws in your jurisdiction that cannot be waived by agreement.
12. Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last Updated" date and provide notice through our Apps. Your continued use after changes are posted constitutes acceptance of the revised Terms.
